What happens if a repo car is never picked up? WHAT IF THE LENDER DOESN'T REPOSSESS YOUR CAR? This means that: You are stuck with it - if the lender doesn't come to pick up the car. You can't sell it - because the lender still has the lien, and selling it would be committing a theft.. I bought a car in Jan 07'. I made payments for about a year and hit hardship. I had to go out of state and left whom I thought was a responsible person in charge of my finances. Long story short, I got a repo letter and many calls 4 months after that. I contacted them back with where the car is. Told them my story. Wanted to fix it.
I bought a car in 2000 and in 2008 I stop paying for it they said they called and said they were going to repossess it. I told them where the car was but they never went and picked it up. In 2011 I started back driving the car again. Now the car has 3 factory recalls on it. I need to get these recalls them because now the car is not working.. See Pratt v. General Motors Acceptance Corporation, 462 F.3d 14; 2006 U.S. App. Lexis 22446; Bankr. L. Rep. (CCH) P80,698; 56 Collier Bankr. Cas. 2d (MB) 1016. So in the First Circuit, if the lender refuses to pick up the car, you can reopen the case and ask that the lender be held in contempt if they do not pick up their collateral.
